By accessing or using BrainPickle at brainpickle.app ("the Service"), operated by Click Clack Labs LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
BrainPickle is a trivia platform that provides daily challenges, topic-based quizzes, AI-generated quizzes, a manual quiz builder, 1v1 challenges, group rooms, free play, leaderboards, streaks, share cards, and related features. Some features require an account. Some features require a paid subscription ("Premium"). The Service may be installed as a progressive web app (PWA) on supported devices.
You may sign in using Google, Apple, or email (via one-time verification code). You are responsible for maintaining the security of your account. You must provide accurate information and keep it up to date. You must be at least 13 years old to create an account or use the Service. We reserve the right to suspend or terminate accounts that violate these terms.

Quiz questions may be generated using artificial intelligence (Google Gemini with Google Search grounding for fact verification, with Anthropic Claude as a fallback). While we review questions for accuracy, we do not guarantee that all AI-generated questions or answers are correct. If you find an error, please use the in-app reporting feature. Questions that receive multiple reports are automatically quarantined for review.
You may create quizzes using the AI quiz generator or manual quiz builder. You are solely responsible for the accuracy and appropriateness of content you create. You retain ownership of your original questions, but grant us a non-exclusive, royalty-free, worldwide license to display, distribute, and make available your quizzes on the Service. We reserve the right to remove user-created content that violates these terms or is reported as inaccurate, inappropriate, or offensive. If you delete your account, your quizzes will be anonymized (your name removed) but may remain available on the Service.
Challenges allow you to compete 1v1 with another player on the same quiz. Your display name, score, and time are shared with your opponent when the challenge is completed. Challenge links are publicly shareable.
Group rooms allow multiple players to play the same quiz asynchronously. Rooms expire automatically after 24 hours. Display names you choose in rooms are visible to all participants. We reserve the right to remove rooms or players that violate these terms.
Premium features (including increased generation limits, ad-free experience, and leaderboard badges) are available via paid subscription. Payments are processed by Polar.sh, our Merchant of Record. Subscriptions renew automatically unless cancelled. You can manage or cancel your subscription from your account settings or the Polar.sh customer portal. Refunds are handled in accordance with Polar.sh's refund policy. We reserve the right to change pricing or Premium features with reasonable notice.
Free accounts are subject to usage limits, including a daily limit on AI quiz generations (currently 1 per day) and a maximum of 10 questions per generated quiz. These limits may change at our discretion. Exceeding limits requires a Premium subscription.
When you create an account, you are auto-enrolled in the following email categories: daily quiz notifications, streak reminders, challenge notifications, weekly digest, and product updates. You can manage each category individually from your account settings. Every email includes a one-click unsubscribe link for that category, and you may unsubscribe from all emails at once. We honor unsubscribe requests immediately.
We provide an embeddable widget that allows third-party websites to display BrainPickle quizzes. By embedding our widget, you agree not to modify its appearance or behavior, remove attribution, or use it on sites that contain illegal, offensive, or misleading content. We reserve the right to disable widget access at any time.
You may report questions you believe are incorrect, ambiguous, outdated, or inappropriate. Reports are reviewed and questions may be quarantined or removed. Abuse of the reporting system (e.g. false or frivolous reports) may result in account suspension.
You can delete your account at any time from the account deletion page. When you delete your account, your personal data (profile, quiz results, streaks, email preferences) will be permanently deleted within 30 days. Quizzes you created will be anonymized and may remain on the Service. Challenge and room records will have your user ID removed.
All content, design, and code on BrainPickle are owned by Click Clack Labs LLC or licensed to us. You may share your quiz results and share cards freely. You may not reproduce, distribute, or create derivative works from the Service itself without our written permission.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not guarantee the accuracy of any quiz question or answer.
To the maximum extent permitted by law, Click Clack Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.
You agree to indemnify and hold harmless Click Clack Labs LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your user-created content.
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in New York.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. Material changes will be communicated via the Service or email.
